By using the Website or giving us your personal information, you agree to this policy. If you do not agree, please do not use the Website or submit your information.

2. Who Is Responsible for Your Information

DigiStar is the “responsible party” under POPIA, which means we decide why and how your personal information is processed.

We do not knowingly collect special personal information (such as health, religious or biometric information), and we ask that you do not send it to us.

4. How We Collect Your Information

  • Directly from you, when you complete a form, email us, call us or message us.
  • Automatically, when you browse the Website, through cookies and analytics tools.
  • From publicly available sources or referrals, where relevant to a project or enquiry.

5. Why We Use Your Information

We process personal information only for specific, lawful purposes, including:

  • Responding to your enquiries and providing quotes.

  • Keeping the Website secure and preventing spam and fraud.
  • Meeting our legal and regulatory obligations.

Our legal grounds

Under POPIA we rely on one or more of the following: your consent; the need to perform a contract with you or take steps at your request; compliance with a legal obligation; and our legitimate interests (or those of a third party), provided they do not unfairly affect your rights.

6. Who We Share Your Information With

We do not sell your personal information. We may share it only where necessary with:

  • Service providers (operators) who help us run our business, such as website hosting, email and newsletter platforms, analytics, spam protection and accounting tools. They may only process your information on our instructions and under appropriate security and confidentiality obligations.
  • Professional advisers, such as accountants and legal advisers.
  • Authorities, where required by law, regulation or a court order.

7. Transfers Outside South Africa

Some of our service providers may store or process information in other countries. Where we transfer personal information outside South Africa, we do so only where the recipient is subject to laws, binding rules or an agreement that provides an adequate level of protection, or where POPIA otherwise permits the transfer.

8. Cookies and Analytics

Our Website uses cookies, which are small text files stored on your device. We use them to make the Website work properly, remember your preferences, understand how visitors use the Website and improve it.

You can control or delete cookies through your browser settings. Blocking some cookies may affect how the Website works. Where we use non-essential cookies, we ask for your consent through our cookie notice.

9. Direct Marketing

We will send you marketing communications only if you have consented, or where POPIA and the Consumer Protection Act allow it (for example, to existing clients about similar services). Every marketing email includes an unsubscribe link, and you can also opt out at any time by contacting us.

10. How We Protect Your Information

We take reasonable technical and organisational measures to protect your personal information against loss, damage, unauthorised access and unlawful processing. These include secure hosting, access controls, up-to-date software and limiting access to people who need it.

No method of transmission or storage is completely secure. If a security compromise affects your personal information, we will notify you and the Information Regulator where required by POPIA.

11. How Long We Keep Your Information

We keep personal information only for as long as it is needed for the purpose it was collected, or as required by law, for example, tax and accounting records. When we no longer need it, we delete or de-identify it securely.

12. Your Rights Under POPIA

As a data subject, you have the right to:

  • Ask whether we hold personal information about you and request access to it.

  • Ask us to delete or destroy information we are no longer entitled to keep.
  • Object to the processing of your information, including for direct marketing.
